Know Your Rights
Carry a Red Card / Llevar la tarjeta roja
The Red Card states your constitutional rights, and you may hand it to an ICE/CBP/etc. agent if you are detained instead of speaking to them. The card reviews your rights on one side, and the other side (for ICE/CBP) reads:
- I do not wish to speak with you, answer your questions, or sign or hand you any documents based on my 5th Amendment rights under the United States Constitution.
- I do not give you permission to enter my home based on my 4th Amendment rights under the US Constitution unless you have a warrant to enter, signed by a judge or magistrate with my name on it that you slide under the door.
- I do not give you permission to search any of my belongings based on my 4th Amendment rights.
- I choose to exercise my constitutional rights.

Judicial Warrant / Orden Judicial
A judicial warrant is an official court order signed by a judge or magistrate that authorizes a search of private property, seizure, or arrest based on probable cause that a crime is being committed or has been committed.
A judicial warrant will:
- Specify the specific address to be searched.
- Specify the time period in which the search must take place.
- Particularly describe the place or person, or both, to be searched and things to be seized.
- Be issued by a court and signed by a Judge or magistrate.

Administrative Warrant
Administrative Warrants (Orden Administrativa)
An ICE administrative warrant is a document, issued by a federal agency such as Department of Homeland Security (DHS) or Immigration and Customs Enforcement (ICE), purporting to document their authority to arrest a person suspected of violating immigration laws. These administrative documents are not signed by a neutral magistrate or judge but rather an immigration officer like an ICE agent or immigration judge.
- An ICE administrative warrant is NOT a judicial warrant. ICE administrative warrants do not give ICE officials authority to enter a place where there is a reasonable expectation of privacy, without consent.
- If this happens—state clearly that you do not consent to them entering but do not physically resist. If ICE officials have already entered, then ask them to leave and state that you do not consent to a search.

Create a Preparedness Plan & Gather Important Documents / Crear un plan de preparación y recopilar documentos importantes
A preparedness plan gathers together important information in one place so that, if the adults in a family are detained, the children and the guardian who steps in have what they need. It can include emergency contact information for friends, family, and an attorney; medical information for children, like doctors and medication. Store this plan with important documents.

List of Documents
Keep copies of your important documents on your phone and e-mail it to family and friends who might need it, as well.
Identification: Gather passports, birth certificates, social security numbers, marriage certificates, and any other form of identification.
Financial Records: Collect tax documents, bank statements, and any documentation related to your Individual Taxpayer Identification Number (ITIN) card, if applicable.
Immigration Records: Compile all immigration documents, including visa or permit copies, receipts for applications, and your alien registration number (A-number).
Medical Information: Collect health insurance cards, medical records, vaccination records, a list of known allergies, and medications.
Legal Documents: Keep copies of any legal documents, such as a power of attorney or guardianship papers, if applicable.
Emergency Contacts: Establish a list of emergency contacts, including family members, friends, and legal representatives.
School and Medical Contacts: Provide school and medical contacts with relevant information and authorization to act on your behalf.
Caregivers: Identify and designate caregivers for children or other dependents, ensuring they have the necessary information and authorization.
Family Preparedness Plan: Develop a comprehensive family preparedness plan that outlines steps to take in case of detention or deportation, including communication strategies and financial arrangements.
Caregiver’s Authorization Form / Formulario de Autorizacion de Cuidador
The Caregiver’s Authorization Form allows a person who is not the parent/guardian of a child assume custody of that child if the parent/guardian is detained. It does not require going to court or notarization to take effect. The person who wants to assume custody completes the form, and either:
The parent/guardian can sign it.
The person completing the form can state that the parent/guardian is unavailable or can’t be found.

Sign Immigration Forms & Have An Initial Consult w/an Attorney / CONSULTE CON UN ABOGADO
This is not legal advice. It’s paraphrased from an Instagram video made by Pedro Chavez, an attorney in Ventura County.
- Sign a copy of Form G-28, which gives an attorney permission to represent someone.
- Sign a copy of Form I-246, which is an application for a stay of deportation or removal.
Having these forms pre-signed makes it easy for an attorney to get started more quickly, rather than having to find someone in detention, get the forms signed, and only then begin talking to ICE.
- Have an initial meeting with an attorney who specializes in removal defense.
- Put these forms with all the other important forms!
- Do not hire an immigration consultant or a notary. Only lawyers, accredited representatives, and recognized organizations can give you legal advice or represent you in immigration court. Immigration consultants – who may call themselves immigration experts, notarios, notaries public, or paralegals – cannot do so.

Update Your School Emergency Contacts / Actualice los contactos de emergencia de su escuela
If parents/guardians are detained (or really, in the event of any emergency), emergency contacts are people authorized to pick up your child from school. It’s really helpful if your list includes:
- The friends/family who would care for the child long-term if needed.
- Friends/family who live or work nearby, who could pick up a child in an emergency and care for them until the long-term guardian arrives.
